United States and Illinois Supreme Court Cases: Schlunk
v. Volkswagenwerk Aktiengesellschaft, 486 U.S. 694 (1988) Jack
Samuel Ring obtained a 9-0 Decision in the U.S. Supreme Court - Decided
March 21, 1988. This decision established the principal that Americans
who are injured on U.S. soil by products designed and/or manufactured
overseas may now be able to serve notice of suit on those foreign
designers and manufacturers through their subsidiaries in the United
States and thus avoid the Hague Service Convention and the cost and
time involved in service of process in a foreign country. As indicated
in ATLA's "Trial", January, 1999, Schlunk is still considered
a recent case. Wirth v. Industrial Commission, 57 Ill.2d 475 (1976)
Jack Samuel Ring appeared before the Illinois Supreme Court and established
that recurrent emotional stress and strain in the workplace can lead
to a compensable injury, and that such an injury need not be based
merely on physical work. Soto
v.E.W. Bliss Division of Gulf & Western, 452 N.E. 2d 572 (1st
Dist.1983) (cert.den.) Affirmed by Illinois Supreme Court. This case
reviewed and addressed the entire field of products liability cases.
Jack Samuel Ring, as principal for the firm of Jack Samuel Ring &
Associates, Ltd. has continually tried and settled cases for injury
victims and their families in the millions of dollars over the years.
A representative sample follows: 1999 - Jack Samuel Ring and Edward
R. Moor secured a $1,473,500.00 verdict for a man who suffered a drop
foot and ulnar nerve injury during surgery to repair hip and pelvic
fractures. 1999 - Secured a $950,000.00 settlement out of a $1 million
dollar policy for the family of a young woman whose Ob-Gyn failed
to diagnose a lump under plaintiff's decedent's arm as a regional
metastases of melanoma. 1998 - Secured a $6 million dollar medical
malpractice settlement on the eve of trial for a young girl by establishing
a deviation from the standard of care by a noted pediatric cardiac
surgeon which resulted in brain damage. 1998 - Secured a $2 million
dollar settlement (policy limit) for a middle aged woman for deviation
from the standard of care by an orthopedic surgeon resulting in loss
of a hip. This case continues against other defendants. $4 million
dollar settlement for employees of a brick fabrication plant who suffered
lung injuries and death as a result of the exposure to silica sand.
Multi-million dollar settlement for wrongful death of husband and
father of three who died as a result of medical malpractice of an
anesthesiologist, an internist, a neurologist and a local hospital's
failure to diagnose and treat a cerebral bleed in the brain. $600,000.00
workers' compensation settlement ($400,000.00 plus actual cash value)
for a police officer who lost his leg while investigating a fire.
$750,000.00 plus workers' compensation settlement benefit ($380,000.00
plus actual cash value) for a policeman who suffered a fracture complicated
by nerve damage to his right arm while making an arrest. Other trials
and settlements have resulted in a million dollar plus settlement
for the adult heirs of an elderly couple who died when they were rear-ended
by a truck, three quarters of a million dollars for a young woman
who suffered post traumatic stress disorder and soft tissue injuries
in the crash of a CTA train, three quarters of a million dollars for
a truck driver who suffered post traumatic stress disorder and torn
ligaments in a crossing accident between his truck and an Amtrack
train, one million dollars for an unemployed female, age 62, who suffered
post traumatic stress, concussion, fractured ribs and congestive heart
failure from which she recovered when rear-ended by a truck in Indiana,
$450,000.00 for an elderly woman in a medial malpractice claim for
the failure of her physicians to diagnose a spinal cord tumor leading
to urinary and fecal incontinence, etc. Jack Samuel Ring has in the
past also obtained various verdicts and/or settlements for other claimants
and victims of over One Million ($1,000,000.00) Dollars for claims
arising from driving accidents, truck and auto collisions, railroad
accidents, medical malpractice claims, construction injury claims,
product liability claims and environmental claims. In addition, Jack
Samuel Ring has obtained numerous settlements of workers' compensation
claims in the high six figure range.
